GENERAL TERMS AND CONDITIONS OF SALE

PREAMBLE:

The site is entirely owned by "haritzgallery.com" along with all related rights. Any complete or partial reproduction is systematically subject to the authorization of the owners. However, hyperlinks to the site are permitted without specific requests.

1. Acceptance of terms

The customer acknowledges having read, at the time of placing the order, the specific terms of sale stated on this screen and expressly declares accepting them without reservation. These general terms of sale govern the contractual relations between "haritzgallery.com" and its customer, both parties accepting them without reservation. These general terms of sale will prevail over any other conditions contained in any other document, except prior, express, and written derogation.

1. Products

The photographs illustrating the products are not contractual. If errors have been introduced, under no circumstances can the responsibility of "haritzgallery.com" be engaged.

HARITZ strives to present and describe its articles as accurately and precisely as possible. However, a possible error or omission could not be attributed to HARITZ, and under no circumstances can HARITZ's responsibility be engaged for this reason. Photographs and videos cannot be held against HARITZ.

1. Order

The automatic registration systems are considered proof of the nature, content, and date of the order. "haritzgallery.com" confirms the acceptance of its order to the customer at the email address that the latter will have communicated. The sale will only be concluded upon confirmation of the order. "haritzgallery.com" reserves the right to cancel any order from a customer with whom there exists a dispute relating to the payment of a previous order. The information stated by the buyer, at the time of the order, commits the buyer: in case of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.

1. Delivery

After order confirmation, "haritzgallery.com" commits to delivering to its carrier all the references ordered by the buyer. This carrier undertakes by contract with "haritzgallery.com" to deliver the order to the buyer's address provided by "haritzgallery.com". In the case of a cash-on-delivery system, the customer commits to paying the carrier or its representative the total amount indicated at the time of order confirmation.

Furthermore, for deliveries outside mainland France, the customer commits to paying all taxes due on importing products, customs duty, value-added tax, and all other taxes due under the laws of the country of receipt of the order. All orders placed with "haritzgallery.com" are intended for the personal use of the clients, the clients or the recipients of the products prohibit any partial or total resale of the products. "haritzgallery.com" is thus relieved of any legal responsibility if the payment of taxes was not made by the client. Possible delays do not entitle the buyer to claim damages. In case of apparent defects, the buyer has the right of return under the conditions provided in this document. Considered as cases of force majeure relieving the seller of its obligation to deliver are war, riot, fire, strikes, accidents, pandemics, health disasters, and the impossibility of being supplied. Goods always travel at the risk and peril of the recipient. Always check your parcel on arrival. You must make any reservations with the carrier in case of missing or damaged items at the time of delivery. For reasons of availability, an order can be delivered to the customer in several times. The customer then only pays for one delivery. If the customer wishes 2 places of delivery, he passes 2 orders, with the delivery charges linked.

1. Retraction

In accordance with Article L.121-16 and following of the Consumer Code, the consumer has a period of 14 days from the date of delivery of their order, to return any item not suitable for them and request an exchange or refund without penalty, except for return costs.

Any return must be sent in its original packaging (tissue paper - square cardboard tube) to protect the product. Haritz Gallery reserves the right to refuse a return if it has not been done properly and the product arrives damaged. In this case, an email with a photo is sent to you. The customer can have their product returned at their expense.

In case of exercising the right of retraction, "haritzgallery.com" is obliged to reimburse the sums paid by the customer, without charges, except for return costs. The refund is due within a maximum period of 30 days, as provided in Article L. 121-20-1 of the Consumer Code.

1. Price

The price is expressed in euros. The price indicated on the product sheets does not include transportation. The price indicated in the order confirmation is the final price, expressed all taxes included and including VAT for France and EEC countries. This price includes the price of the products, the costs of handling, packaging and conservation of products, the costs of transport and commissioning.

1. Payment

The price invoiced to the customer is the price indicated on the order confirmation sent by "haritzgallery.com". The price of the products is payable in cash on the day of the actual order. Payment is made by credit card bearing the CB logo. The transaction is secured by the STRIPE platform. It is the current standard. At no time does "haritzgallery.com" have access to your banking information, the payment is made directly on the bank's secure platform (at the end of the order process in "my cart") and "haritzgallery.com" does not have access to your banking information.

1. Disputes

This contract is subject to French law. "haritzgallery.com" cannot be held responsible for damages of any kind, both material and immaterial or bodily, that could result from a malfunction or improper use of the marketed products. The same is true for any possible changes in products resulting from the manufacturers. The responsibility of "haritzgallery.com" will, in any event, be limited to the amount of the order and cannot be blamed for simple errors or omissions that could have remained despite all the precautions taken in the presentation of the products. In case of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution especially with the help of: a professional association of the branch, a consumer association or any other advice of his choice. It is reminded that the search for the amicable solution does not interrupt the "brief delay" of the legal warranty, nor the duration of the contractual guarantee. It is reminded that as a general rule and subject to the assessment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller.

Complaints or disputes will always be received with attentive benevolence, the good faith being always presumed in the one who takes the trouble to expose his situations. In case of dispute, the client should first contact the company to obtain an amicable solution.

1. Warranty

In all cases, "haritzgallery.com" cannot be held responsible for non-compliance with regulatory and legislative provisions in force in the receiving country, the responsibility of "haritzgallery.com" is systematically limited to the value of the product in question, value at its date of sale and without possibilities of recourse towards the brand or the company producing the product. In any event, the customer benefits from the legal warranty of eviction and hidden defects (Art.1625 and following of the Civil Code). Provided that the buyer makes the proof of the hidden defect, the seller must legally repair all the consequences (art.1641 and following of the civil code); if the buyer goes to the courts, he must do so in a "brief delay" from the discovery of the hidden defect (art.1648 of the civil code).

1. Legal Information

The filling in of personal information collected for the purpose of distance selling is mandatory, this information being essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. The lack of information leads to the non-validation of the order. In accordance with the "Informatique et Libertés" law, the processing of personal information relating to customers has been declared to the National Commission of Informatics and Liberties (CNIL). The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification, and deletion of the data which concern him, which he can exercise with "haritzgallery.com". Moreover, "haritzgallery.com" commits to not communicating, free of charge or with a counterpart, the coordinates of its customers to a third party.
